Welcome to Circulus Art. These Terms and Conditions govern your use of our website and the purchase of artworks through our platform.
By using this website or placing an order, you agree to these Terms. 

1. About Us
Circulus Art is an online platform that connects customers with independent artists.
We curate and present original artworks created by selected artists and facilitate the sale of these works through our website.
Circulus Art works with a carefully selected group of independent artists whose work we curate and present on our platform.
While Circulus Art coordinates the sale and manages the transaction, the artwork itself is created by and originates from the individual artist.
Artworks are shipped directly from the artist’s studio to the customer.

2. Eligibility to Use Our Website
To purchase from our website you must:
• be at least 18 years old
• provide accurate contact and delivery information
• use the website only for lawful purposes
We reserve the right to refuse or cancel orders if these conditions are not met.

3. Artwork and Product Descriptions
Each artwork featured on Circulus Art is created by an independent artist.
We make every effort to ensure:
• images accurately represent the artwork
• descriptions are clear and truthful
• dimensions and materials are stated where relevant
As many artworks available on Circulus Art are handmade or created using natural materials, small irregularities or variations in texture, finish or detail may occur. These characteristics are part of the nature of original artworks and are not considered defects.
Colours may appear slightly different depending on screen settings.
Customers are responsible for reviewing the dimensions of the artwork before purchasing. Images on the website may include contextual or lifestyle photographs to illustrate the artwork, and these may not represent the exact scale.
Frames, props or interior settings shown in images are for illustrative purposes only unless explicitly stated in the artwork description.

4. Authenticity of Artwork
Circulus Art works with selected independent artists and expects that all artworks offered on the platform are original works created by the artist presenting them.
The artist is responsible for the authenticity and originality of the artwork they supply.
Circulus Art does not independently authenticate artworks but will work with customers and artists to address any concerns regarding authenticity.

5. Pricing
All prices are listed in GBP (£).
Prices do not include delivery unless stated otherwise.
We reserve the right to change prices at any time, but the price shown at the time of purchase will apply to your order.

6. Orders and Payment
When you place an order:
1. You will receive an order confirmation email.
2. Payment will be taken at the time of purchase.
3. Your order is accepted once the artwork availability has been confirmed and you receive a confirmation from Circulus Art that the order has been accepted.
In rare cases, an artwork may become unavailable (for example if it sells simultaneously elsewhere). If this happens we will notify you and issue a full refund. 

7. Shipping and Delivery
Artworks sold through Circulus Art are shipped directly by the artist.
Delivery times may vary depending on the artist’s location and production requirements.
Delivery time estimates are provided as guidance only and are not guaranteed.
Customers are responsible for ensuring the delivery address is correct.
Circulus Art is not responsible for delays caused by:
• postal or courier services
• customs processing
• events outside our control
If an item arrives damaged, please contact us as soon as reasonably possible after delivery and provide photographs of the packaging and item.

8. Returns and Cancellations
Under the Consumer Contracts Regulations 2013, customers have the right to cancel most online purchases within 14 days of receiving the item.

Returned artworks must:
• be in original condition
• be securely packaged
• be returned within 14 days of cancellation
Customers are responsible for return shipping costs unless the item is faulty or damaged.
Refunds and cancellations are handled in accordance with our Returns & Cancellations Policy.

9. Faulty Items
If an artwork arrives damaged, faulty, or significantly different from its description, please contact us as soon as possible and within 30 days of delivery.
Please contact us within 30 days and we will arrange:
• a refund
• a replacement where possible
• or another appropriate solution

10. Copyright & Intellectual Property
All content on the Circulus Art website, including text, graphics, logos, website design, photographs and videos, is the property of Circulus Art unless otherwise stated and is protected by copyright and intellectual property laws.
Copyright in the artworks themselves remains with the individual artist unless otherwise stated.
Purchasing an artwork does not transfer copyright. The buyer acquires ownership of the physical artwork only and may not reproduce, distribute or commercially exploit the artwork without the artist’s permission.

11. Artist Representation
Circulus Art works with independent artists whose work we curate and present on our platform.
Artists remain responsible for ensuring that the artworks they offer are their own original creations and do not infringe the rights of others.

12. Limitation of Liability
To the fullest extent permitted by law, Circulus Art shall not be liable for:
• indirect or consequential losses
• delays caused by third-party delivery services
• website interruptions or technical issues
Nothing in these Terms limits your statutory rights as a consumer.

13. Events Outside Our Control
Circulus Art shall not be responsible for delays or failure to fulfil obligations caused by events beyond our reasonable control. These may include natural disasters, strikes, transportation disruptions, internet outages or other unforeseen circumstances.

14. Privacy
Our handling of personal data is explained in our Privacy Policy.

15. Changes to These Terms
We may update these Terms occasionally to reflect changes to our services or legal requirements.

16. Governing Law
These Terms are governed by the laws of England and Wales.
